Alternative Ways to Resolve a Court Case

Mediation and arbitration are both private forms of alternative dispute resolution (ADR). Essentially, these disputes never see the courtroom and are therefore not a matter of public record.

What Is the Difference Between Mediation and Arbitration?

Mediation is a bit more informal and involves a mediator or neutral third party who helps two individuals agree to a settlement. In mediation, the individuals involved in the dispute are responsible for reaching their own resolution. As such, the mediator can offer helpful advice or suggestions, but he or she cannot impose any decisions on either individual involved.

Arbitration differs from mediation as it is more formal and relies on an arbitrator, not a mediator, to settle a dispute. The arbitrator is also a third party, however,in this process he or she acts as a decision- maker. The arbitrator follows formal rules of procedure and often has some expertise in the area that is the subject of the dispute.

What Are the Advantages and Disadvantages of Mediation and Arbitration?

Both mediation and arbitration have advantages and disadvantages in terms of resolving disputes. The main advantages these processes have over taking a case to trial are the cost and time savings. Additionally, since both parties take part in resolving the dispute, they are much more likely to settle and move forward with the agreed-upon resolution.

There are some potential disadvantages to these processes as well. As mediation is not expected to follow legal precedent when coming to a resolution, a case runs the risk of not being resolved by the individuals involved and will then have to be taken to court as a result. A disadvantage to arbitration is that the decision made here is final. An individual cannot appeal this decision even if he or she feels the resolution was unfair, biased, or wrong.

What Is Christian Mediation?

Christian mediation focuses on reaching a resolution, but it also encompasses the spiritual and emotional issues that might arise during the process as well. The goal here is to not just perform a transaction, but rather foster a process of healing as well.
