Mediation and arbitration are the two main types of alternative dispute resolution (ADR). Alternative dispute resolution is the general term given to methods of resolving conflicts without involving a courtroom, a judge, or a jury.

Basic Definitions: Mediation & Arbitration

Mediation and arbitration can save time and money in a wide range of legal conflicts — ranging from divorces and child custody disputes to business conflicts and neighborhood disputes.

In mediation, the parties seek help from a third person known as the mediator. The mediator is neutral, which means that he or she does not have any personal or financial interest in the outcome of the conflict. The parties to the dispute each describe their version of the conflict to the mediator, who then works with each party to develop potential compromise solutions.

Mediation is nonbinding. This means you are under no legal obligation to accept the mediator's suggestions. If the mediation fails, you are free to attempt another form of alternative dispute resolution or file a formal lawsuit to resolve the conflict.

  • Often leads to a more satisfying result

Arbitration differs from mediation in that the neutral third person is actually a decision maker. He or she issues a ruling about how to resolve the conflict. You must agree ahead of time to abide by the arbitrator's ruling.

What Is Christian Mediation?

Christian mediation places the parties' conflict inside a framework of Christian and biblical values. Whereas secular mediation addresses only material issues like financial loss and gain, Christian mediation includes hard-to-quantify issues like the parties' long-term relationship and the value of an emotionally healthy family.

Christian mediation may ask the parties to examine their own roles in causing or continuing the conflict. "How can you say to your brother, 'Let me take the speck out of your eye,' when all the time there is a plank in your own eye?" Matthew 7:4
